1. Acceptance of Terms
By downloading, installing, or using the Bahr (بحر) mobile application ("App") or any of its associated services, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you must not use the App.
These Terms apply to all users, including guests (travelers), property owners, and administrators. Bahr reserves the right to update these Terms at any time.
2. Definitions
- "Bahr" / "We" / "Us": Refers to Bahr Technologies, the developer and operator of the App.
- "Guest": A user who browses, searches, and books properties through the App.
- "Owner": A property owner or manager who lists units for rental on the App.
- "Booking": A reservation made by a Guest for a specific property for defined dates.
- "Platform": The Bahr App, website (if applicable), and all related services.
3. Eligibility
You must be at least 18 years of age to use the Bahr platform or make a booking. By creating an account, you represent that you meet this requirement. Bahr reserves the right to suspend or terminate accounts that violate this requirement.
4. Account Registration
- You must provide accurate, complete, and current information when creating an account.
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activities that occur under your account.
- Notify us immediately of any unauthorized use of your account at support@bahrnorthcoast.com.
- Each person may only maintain one account. Duplicate accounts may be suspended.
5. Bookings & Reservations
When you submit a booking request through the App:
- A booking is considered confirmed only upon receipt of a confirmation notification from Bahr and/or the property owner.
- Pricing displayed is in Egyptian Pounds (EGP) and includes applicable service fees unless otherwise stated.
- Dynamic pricing may apply during peak seasons or based on stay duration. Final pricing is shown at checkout before payment.
- Promotional codes and discounts are subject to validity terms and cannot be combined unless explicitly stated.
- Guests must respect the maximum occupancy limits specified for each property. Violations may result in immediate termination of the stay without refund.
6. Payments
- Bahr supports multiple payment methods: Credit/Debit Card, InstaPay, Vodafone Cash, Bank Transfer, and Cash on Arrival.
- Payments are processed by third-party payment gateways. By completing a payment, you also agree to the terms of those providers.
- Bahr does not store full card details. All card processing is handled by PCI-DSS-compliant providers.
- A service fee and/or refundable insurance fee may be applied to certain bookings and will be clearly displayed before payment confirmation.
- Bahr is not responsible for fees charged by your bank or financial institution.
7. Cancellations & Refunds
Each property listing may have its own cancellation policy. The applicable policy is shown on the property detail page and at checkout. General guidelines:
- Free Cancellation: Where offered, cancellations made within the specified window receive a full refund minus any non-refundable fees.
- Partial Refund: Cancellations outside the free window may receive a partial refund as defined in the listing's policy.
- Non-Refundable: Some bookings are non-refundable. This will be clearly marked before checkout.
- Insurance Fee: The refundable insurance/security deposit is returned within 7–14 business days after a clean checkout, provided no damages are reported.
- Bahr acts as a marketplace facilitator and is not responsible for refund disputes between guests and property owners beyond platform mediation.
8. Guest Conduct
By booking through Bahr, guests agree to:
- Treat all properties with care and respect, leaving them in the condition they were found.
- Not exceed the maximum occupancy specified in the listing.
- Not use properties for illegal activities, events, or commercial purposes without prior written approval.
- Comply with all check-in instructions and property-specific rules provided at confirmation.
- Report any damage or issues to the property owner and Bahr support promptly.
Violations may result in account suspension, liability for damages, and reporting to relevant authorities.
9. Owner Responsibilities
Property owners who list on Bahr agree to:
- Provide accurate, truthful, and up-to-date information about their properties.
- Maintain their listings' availability calendars to prevent double-bookings.
- Honor all confirmed bookings except in cases of force majeure.
- Treat guests fairly and without discrimination.
- Comply with all applicable Egyptian laws regarding property rental and taxation.
10. Intellectual Property
All content within the Bahr App, including but not limited to the logo, design, text, graphics, code, and user interface elements, is the exclusive property of Bahr Technologies and is protected by copyright, trademark, and other applicable laws. You may not copy, reproduce, distribute, or create derivative works without our express written permission.
11. Limitation of Liability
To the fullest extent permitted by Egyptian law:
- Bahr is a marketplace platform. We are not a property owner, travel agent, or insurer.
- Bahr is not liable for the conduct of guests or property owners, or for disputes between them.
- We are not responsible for property descriptions that prove inaccurate, subject to property owners' obligations.
- Our total liability to you for any claim arising from use of the App shall not exceed the total fees paid by you to Bahr in the 12 months preceding the claim.
- Bahr shall not be liable for indirect, incidental, special, or consequential damages.
12. Termination
Bahr reserves the right to suspend or terminate your account at its sole discretion if you violate these Terms, engage in fraudulent activity, or for any other reason. Upon termination, your right to use the platform ceases immediately. Pending bookings will be handled on a case-by-case basis.
13. Governing Law & Disputes
These Terms are governed by the laws of the Arab Republic of Egypt. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts of Egypt. We encourage resolving disputes amicably through our support channels before pursuing legal action.
14. Force Majeure
Neither party shall be liable for failure to perform obligations due to events beyond reasonable control, including natural disasters, war, government actions, pandemics, or major infrastructure failures.
15. Changes to Terms
We may revise these Terms at any time. Significant changes will be communicated via in-app notification. Continued use of the App after changes are published constitutes acceptance of the revised Terms.
